We want you to understand the services CENTS will provide you in this program:

CENTS will provide you with adequate credit counseling as a requirement for filing for bankruptcy protection.

During the counseling session you will be able to learn how to: think about money management; identify your assets and debts; make a complete debt list; budget; balance your budget; calculate your spending percentage; reduce expenses and/or increase income to balance your budget or change your spending percentages; respond to a financial challenge.

You will learn how to evaluate your financial situation and get on a path to improve it.

CENTS charges $15 per person. Married couples must take this course independently and each spouse must get his or her own certificate. (The second class, the post-filing class you take after you file for bankruptcy, can be taken together.)

For our program to work most effectively, we need you to be diligent and truthful while answering the program's questions. The more accurate your answers are, the more relevant the information you'll receive.

The program has an interaction requirement. You must provide CENTS a working email address so we can email you an analysis after class. This interaction is required to complete the course. After the interaction, we will email your certificate.

Your course will be taught by a qualified instructor. The class curriculum was designed by Anthony Leahy. Mr. Leahy will teach and review your course. Mr. Leahy, a lawyer and Executive Director of CENTS, has over 10 years of classroom experience, including nine years teaching personal financial management and consumer credit education. He has designed four personal finance curricula.

CENTS is not responsible for any financial decisions that you choose to make. Financial decisions are highly personal and one must weigh many factors. This program will help you learn about your financial situation, but you must make the decision about your next steps. By signing this agreement, you agree to release CENTS from any liability.

You agree to provide CENTS with accurate and complete information.

Thank you for your interest in CENTS' online class for bankruptcy filers. This is CENTS' fifth curriculum designed for adults. A new bankruptcy law went into effect on October 17, 2005. The law requires consumers seeking bankruptcy protection to complete a credit counseling class before filing bankruptcy. The United States Trustee (UST), a branch of the United States Department of Justice oversees the program and maintains a list of approved providers. The United States Trustee has reviewed and approved CENTS' credit counseling services and its personal financial management instructional services under 11 USC 111(d). The United States Trustee has not reviewed or approved any other services that CENTS provides. Approval does not endorse or assure the quality of a provider's services.

CENTS does not receive any funding from any agency.

Timing of course: To comply with the UST's requirements, you should take CENTS' credit counseling course for bankruptcy filers before filing for bankruptcy. You can decide whether to file or not after you take our course. There are two bankruptcy courses: 1) a credit counseling class BEFORE filing bankruptcy (also called a pre-filing class) and 2) a debtor education course AFTER you file bankruptcy and AFTER have a case number. The second course is also called a personal financial management instructional course, a post filing course, and/or a pre-discharge course. Please take special care not to confuse these two classes and ask us if you have questions.


Privacy policy: CENTS will not sell your information. CENTS will also not share your information, unless legally required to do so. CENTS may disclose your information to the UST in connection with the UST's oversight of CENTS. All information gathered will be strictly safeguarded and stored in a safe manner. We will limit the mandatory collection of information to the minimum required to provide necessary services, which includes performing assessments of your financial situation, determining the factors that led to your financial problems, assistance in preparing a budget, analyzing the budget and providing tips, performing a debt analysis, and informing you of the various alternatives to your financial situation without incurring a negative amortization of debt.

Information collect by CENTS is treated as confidential. No personally identifiable information will be released to any outside person or to any company unless required to do so by law or expressly authorized to do so by you or your attorney. CENTS will never share information with any creditor, collection agency, or credit reporting agency. We will not sell, rent, loan, lease, or trade your contact information or email. CENTS reserves the right to collection information regarding the use of its website and educational program.

Impact on your credit report: CENTS does not provide any debt management plans, debt or credit repair services, or contact creditors on behalf of clients. CENTS has no impact on your credit reports. We do not report any information to any credit reporting agency or bureau. Please note: bankruptcy or some credit counseling plans, including debt management plans, will affect your credit report.

No Contract: you will not enter into a contract with CENTS.

Your counseling session will last at least 60 minutes and will help you better understand your current financial situation and options for your next steps. We will also answer any questions you have.

The program was designed by CENTS Executive Director Anthony Leahy. He has designed several online and multimedia educational programs, including Innovo: reconstructing your finances after bankruptcy; Debt Slapped; Debt Slapped Grad; and Smart Borrowing. He received his Juris Doctor from the University of Washington School of Law in 2001 and has worked for CENTS since 2002.

Please be advised that we cannot offer you legal advice. Please know that any options or information you receive from us is only as good as the information you provide us about your situation. We want you to take control of your financial situation. We are not responsible for any financial decisions you choose to make.

Upon completion of this course, you will fill out a certificate registration page. CENTS will then provide you or your attorney with a certificate of course completion. It will be your responsibility to make sure you receive the certificate. Allow one business day. If you do not receive your certificate by one business day, it will be your responsibility to contact us. If you have CENTS email you the certificate, it will be your responsibility to file the certificate with the court or provide to your attorney to file with the court. CENTS does not file the certificates for you. We will email the certificate to you or directly to your attorney if you provide your attorney's address in the certificate registration form.

Services offered in languages other than English: CENTS' class is in English. If you have limited English proficiency, we recommend you take the debtor education/personal financial management instructional course with a provider that offers the class in your proficient language. We will refund your payment if we or you determine you cannot understand our class and you will seek the class and certificate from another provider.

Fee Schedule: CENTS is committed to providing a quality class. The fee is $10 per individual or $15 for joint filers.

Fee Waiver: Any debtor who does not opt out of providing financial records and information will be considered for a fee waiver. Every debtor also has the option to opt out of providing financial income information. A decision will be made on a case-by-case basis and the class will be made available regardless of the client's ability to pay. If available, please provide Consumer Education and Training Services ("CENTS") 1) a copy of your most current paystub and 2) bank statement. 3) Please also include a brief narrative statement of your financial situation, and make sure it includes a) the total of your annual income (including income from jobs, alimony, child support, benefits, et cetera) and b) how many people live in your household. 4) Please also provide your place of employment. 5) If you are married, a) please list your spouse's place of employment. Finally, 6) please include your name and contact information and 7) what class you would like to take (pre-filing credit counseling or post-filing debtor education). Please email the information to A client may receive a fee waiver if the annual household income is less than 150% of the Federal Poverty Guidelines issued by the Department of Health and Human Services. CENTS is a 501(c)(3) non-profit organization and it receives its funding through foundation grants, special fundraising events, individual donors, and program fees. Please note CENTS does not pay or receive fees or other consideration for the referral of debtors.
